1. Acceptance of terms

These Terms of Service govern your access to and use of the website renderconstructionwapty.site and any services provided by Render Construction Wa Pty Ltd (ABN 97 699 727 789, ACN 699 727 789) ("we", "us" or "our").

By accessing our website, requesting a quote, or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services. We may update these Terms from time to time; the latest version will be posted on this page.

2. Our services

We provide exterior wall rendering, texture coating, surface preparation, repointing and restoration services to residential and commercial clients across Western Australia.

All quotes are valid for 30 days from the date of issue unless otherwise stated. Work will commence only after a written or emailed acceptance of the quote and receipt of any required deposit.

We reserve the right to refuse or decline any project at our sole discretion, and to reschedule work subject to availability and reasonable notice.

3. Pricing and payment

All prices quoted are in Australian dollars (AUD) and are inclusive of GST where applicable. Unless otherwise agreed in writing, payment is due in full upon completion of the work.

A deposit may be required to secure your booking. Final payment is due before, at, or within 7 days of, project completion unless a different payment schedule is agreed in writing.

Late payments may incur interest at the maximum rate permitted by law. We may suspend or withhold further work until payment is received in full.

4. Australian Consumer Law guarantees

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy provided under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law). You may have non-excludable statutory guarantees including that our services will be provided with due care and skill, are fit for purpose, and are supplied within a reasonable time.

If a defect or failure arises, you may be entitled to a repair, replacement, refund or reduction in price under the ACL, depending on the nature of the breach.

5. Limitation of liability

Except for liability that cannot be excluded or limited under the Australian Consumer Law, our total liability to you for any claim arising out of or related to these Terms or our services (whether in contract, tort, statute, or otherwise) is limited to, at our option, the re-performance of the services or the refund of the fees paid for those services.

We are not liable for any indirect, incidental, special, consequential or exemplary damages, including loss of profits, data, goodwill, or business opportunity, even if we have been advised of the possibility of such damages.

This limitation applies to the maximum extent permitted by law and includes any liability arising from delays caused by factors beyond our reasonable control, including but not limited to weather, supply chain disruptions, or third-party delays.

6. Your obligations

When engaging our services, you agree to:

• Provide accurate and complete information about your project and property.
• Provide safe and reasonable access to the work site at the agreed time.
• Obtain any necessary permits, approvals or consents for the work.
• Pay invoices in accordance with the agreed payment schedule.

If you fail to provide access or delay the work without reasonable cause, we may reschedule and charge a reasonable fee to cover our costs.

7. Intellectual property

All content on this website — including text, graphics, logos, images, audio, data, software and the underlying code — is the property of Render Construction Wa Pty Ltd or its licensors and is protected by Australian and international copyright, trademark and other intellectual property laws.

You may view and download material from the website for your personal, non-commercial use only. Any other use, including reproduction, modification, distribution, transmission, republication or display, is strictly prohibited without our prior written consent.

All trademarks, product names and company names or logos referenced on the website are the property of their respective owners. No licence or right is granted to you to use any trademark displayed on the website without our express written permission.

8. User content and reviews

Where you submit comments, reviews, photos or other content to us (including via our website or social media), you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify, publish and distribute that content in any media.

You agree that the courts of Western Australia are the exclusive venue for resolving any dispute, and you irrevocably submit to the non-exclusive jurisdiction of those courts.

11. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Render Construction Wa Pty Ltd with respect to your use of our website and services, and supersede any prior or contemporaneous communications, representations, or agreements, whether oral or written.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
